California Notice of Privacy Practices

HIPAA, CMIA & CCPA/CPRA Compliant

Effective Date: January 2026

This Notice describes how medical information about you may be used and disclosed, and how you can access this information. This Notice applies to residents of California and is intended to comply with the Health Insurance Portability and Accountability Act (HIPAA), the California Confidentiality of Medical Information Act (CMIA), and applicable provisions of the California Consumer Privacy Act (CCPA) as amended by the CPRA.

Our Legal Duties

Benevolent Health Care Centers is required by law to:

  • Maintain the privacy and security of your Protected Health Information ("PHI")
  • Provide you with this Notice explaining our legal duties and privacy practices
  • Follow the terms of this Notice currently in effect
  • Notify you following a breach of unsecured PHI

What Information Is Protected?

Protected Health Information (PHI) includes any individually identifiable information relating to your health condition, medical care, or payment for care, including information in electronic, paper, or oral form.

Under California law (CMIA), medical information is afforded protections that may be more stringent than federal HIPAA requirements.

How We May Use and Disclose Your Information

We may use or disclose your PHI without your written authorization for the following purposes:

Treatment

To provide, coordinate, or manage your health care

Payment

To bill and collect payment for services provided

Health Care Operations

Quality improvement, audits, training, licensing, and compliance activities

Legal Requirements

When required by federal, state, or local law, including public health reporting

Any other use or disclosure not described in this Notice will be made only with your written authorization, unless otherwise permitted or required by law.

Your Rights Under HIPAA and California Law

You have the right to:

  • 3Request restrictions on certain uses or disclosures of your PHI
  • 4Request confidential communications
  • 5Receive an accounting of disclosures
  • 6Receive a paper copy of this Notice upon request

Additional California Privacy Rights (CCPA/CPRA)

To the extent applicable, California residents also have the right to:

  • • Know what categories of personal information are collected and used
  • • Request deletion of certain personal information (subject to legal exceptions)
  • • Limit the use and disclosure of sensitive personal information
  • • Not be discriminated against for exercising privacy rights

Medical information governed by HIPAA and CMIA is generally exempt from CCPA/CPRA, but we honor applicable California privacy protections where required.

Complaints & Contact Information

If you believe your privacy rights have been violated, you may file a complaint with us or with the California Department of Public Health or the U.S. Department of Health and Human Services. You will not be retaliated against for filing a complaint.
